Waiver and Release (Including on Behalf of a Minor) And Permission to Use Personal Images AGREEMENT


IN CONSIDERATION of being permitted to participate in any way in one or more activities organized, sponsored, managed and/or operated by Yona Lacrosse(“YONA LACROSSE”) including, but not limited to, any, camps, skill sessions and/or lessons (individually and collectively, an “Activity”), I, the undersigned, for myself AND, IF APPLICABLE, ON BEHALF OF THE MINOR CHILD NAMED BELOW OF WHICH I AM THE PARENT OR LEGAL GUARDIAN (as applicable, “Participant”), and for my, his and her respective personal representatives, assigns, heirs, and next of kin hereby: (i) acknowledge, agree, and represent that I understand the nature of the Activity and that Participant is qualified, in good health, and in proper physical and mental condition to participate in such Activity; (ii) agree and warrant that if at any time I believe Participant’s physical or mental condition changes or that any other condition is unsafe, I will immediately discontinue further participation in the Activity;

(iii) FULLY UNDERSTAND THAT: (a) THE ACTIVITY INVOLVES RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING, BUT NOT LIMITED TO, PERMANENT DISABILITY, PARALYSIS, AND DEATH (individually and collectively, “RISKS AND DANGERS”); (b) these Risks and Dangers may be caused by my own or my minor’s actions or inactions, the actions or inaction’s of others participating in the Activity, the location, facilities and/or conditions in which the Activity takes place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED ABOVE; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND DANGERS, AND ALL RESPONSIBILITY FOR LOSSES, COSTS, EXPENSES, INJURIES AND DAMAGES I incur as a result of my participation or that of the minor in the Activity;

(iv) HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE YONA LACROSSE, Alberici Lacrosse LLC, and, as applicable, their respective administrators, coaches, directors, agents, officers, members, volunteers, employees, legal representatives, heirs, next of kin, attorneys, successors and assigns, as well as all other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (individually and collectively, “RELEASEES”) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE ACTIVITY, THE ACTIONS OR IN ACTIONS OF THE RELEASEES, (INCLUDING, BUT NOT LIMITED TO, ATTEMPTED RESCUE OPERATIONS, MEDICAL CARE OR OTHER EMERGENT RESPONSE TO INJURY).

(v) I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

I, for myself and, if different, on behalf of Participant, do hereby grant permission to Yona Lacrosse, its owners, officers, managers, employees, contractors, agents, representatives, successors, licensees and assigns to capture the image of Participant, whether by photographic, video, digital or other imagery or media (individually and collectively, the “Images”), and to use such Images in the manner described herein. I hereby grant permission to Yona Lacrosse to edit, crop, or retouch such Images, and waive my rights to inspect and/or approve the final versions thereof. I hereby consent to and permit all such Images to be used by Yona Lacrosse worldwide for any purpose, including, but not limited to, commercial, educational and advertisement purposes, and in any medium, including print and electronic.
I understand that Yona Lacrosse may use such Images without associating any names thereto. I further waive any claim for any royalty, fee or any other compensation of any kind from Yona Lacrosse for its use or publication of such Images in the manner contemplated herein.
I hereby fully and forever discharge and release Yona Lacrosse, its principals, members, managers, employees, contractors, representatives, agents, attorneys, successors and assigns from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness, or image) arising out of the use or publication of such Images by Yona Lacrosse, and covenant and covenant and agree not to sue or otherwise initiate legal proceedings against Yona Lacrosse or any of the foregoing individuals or entities for such use or publication. All grants of permission and consent, and all covenants, agreements and understandings contained herein are irrevocable.

I HAVE READ AND UNDERSTAND ALL OF THE TERMS, CONDITIONS, AGREEMENTS, WAIVERS, RELEASES, GRANTS OF RIGHTS AND OTHER PROVISISIONS CONTAINED IN THIS DOCUMENT AND AGREE TO BE FULLY BOUND THEREBY, FOR MYSELF AND, IF DIFFERENT, ON BEHALF OF PARTICIPANT.
